When you make a booking you enter into a contract with Mountain Biking Valencia, Calle Poeta Eduardo Buil 3, 46020 Valencia, Spain. These booking conditions, together with the information set out on our website form the basis of your contract. In these Booking Conditions, “you” and “your” mean all persons named on the booking (including anyone who is added or substituted at a later date). “We”, “us” and “our” mean Mountain Biking Valencia.
1. What´s Included
1.1 Guided Tour prices includes the services of the tour leader throughout. The following items are not included – travel and or activity insurance, drinks and food (unless specified in the tour details), tips and items of a purely personal nature.
1.2 Changes to the itinerary may occur even though tours are always carefully planned. Changes will only be made to the stated itinerary if in our opinion it will benefit the tour by providing an improved trip. The itinerary detailed in the tour pages is therefore an illustration of the areas we may visit. As a courtesy to you, any major changes to the itinerary will be advised either prior to the start of the tour or during it.
1.3 We are always very happy and willing to provide further information as required, such as clothing recommendations etc. We will do all within our reasonable power to make the trips or courses as enjoyable and rewarding as possible. However, events such as floods, storms, fires etc. may prevent the tour from visiting certain areas. We will not accept responsibility for this.
2.Reservations & Payments
2.1 To make a booking you must supply the requested information and pay a deposit as stated. Once payment of the deposit has been received a confirmation invoice (or e-mail) will be posted to you. At this point, a contract between you and us comes into existence, with all contracts and matters arising from it are subject to Spanish law and the exclusive jurisdiction of the Spanish courts. We reserve the absolute right to decline any applications for bookings for any legal reasons whatsoever, at our sole discretion.
2.2 Payment of the balance of the tour / course / bike rental price is to be made in cash on the morning of the tour / course / rental. If you do not pay the said amount at that time we reserve the right to treat the booking as cancelled and to retain the deposit.
2.3 You may transfer your booking before the tour date to another person if you are unavoidably prevented from travelling, and the transferee meets any conditions which may apply to the booking. There is no charge for such.
2.4 Save as provided in 2:5 or 2:6 below, deposits are non-refundable but in some cases may be transferable to another specified tour. In all cases we aim to be as flexible and reasonable as is possible.
2.5 When calculating the tour prices in advance, we try to anticipate the rising costs of ground transportation, fuel etc. We reserve the right to make changes to and correct errors in advertised prices at any time before your holiday is confirmed. We will advise you of any error of which we are aware and of the then applicable price at the time of booking. If unexpected significant cost rises do occur after your booking has been confirmed, we may have to increase the tour cost. If it is necessary to increase the tour cost, you will be notified not less than six weeks before the departure date with an explanation of the amount. Should it be necessary to increase the tour cost by more than 10%, you may withdraw without penalty.
2.7 Payments of deposits can be paid by PayPal or by electronic transfer into our Spanish bank account. Further information will be provided at the time of booking.
3.1 Travel and activity insurance is highly recommended. This should cover you fully against medical expenses, injury, death, repatriation, equipment and money loss and liability cover. Please read your policy details carefully and take them with you on holiday. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particular needs. We do not check alternative insurance policies. We insist that you bring your EHC (European Health Card) and that you provide us with your insurance policy numbers and emergency contact details prior to the start of any Guided Tours or Skills Courses.
3.2 We will always adapt and recommend tours according to the participants. However, if you have any health problems or physical limitations you are required to advise us prior to booking. Depending on the season and weather conditions, our tours sometimes involve early starts or late finishes. However, it is always our style of operation to adapt the tour to the general capability of the group wherever possible. First Aid and Health & Safety procedures are always fully explained prior to departure. Our Health & Safety systems require the client to inform us of any relevant medical condition prior to any trip or course. This information is always treated as fully confidential.
3.3 The success of each tour depends to a great extent on the members´ ability to participate physically and cooperate with other party members and the leader. The leader has full authority to exclude any member, either from part of the daily programme or, in extreme cases, from the entire tour if he or she is, in the reasonable opinion of the tour leader, either physically unable to participate, behaves in a way which is detrimental to the interests or safety of the party as a whole, is inadequately equipped or does not have travel insurance, without any liability on our part. Refunds may be made in appropriate cases at our discretion.
3.4 We will take all reasonable steps to ensure that all services provided are of an acceptable standard. We cannot however, accept liability for physical injury, loss, damage or expense resulting from any event whatsoever beyond my our control.
4. Bike Rental
4.1 Rental price includes a clean and well maintained / serviced bike. Each bike comes with a safety helmet, tool kit, puncture repair kit and pump. General repairs and maintenance based on normal wear and tear is included in the rental price.
4.2 Damage to the bike as a result of crashing will be charged to the client. This will be based upon cost price for any necessary replacement parts. Punctures are also excluded and will be charged to the client as an additional cost (at a rate of €3 Euros per puncture as a means of replacing the spare inner tube).
4.3 Although our bikes are constantly maintained to a very high standard, clients must be responsible for their own safety and should have adequate personal and holiday insurance. Safety helmets are provided by us and should be worn at all times.
4.4 A refundable deposit of €50 per bike is payable upon collection and will be refunded upon the return of the bike (undamaged).
4.5 ID must be provided when renting a bike from us.
